On February 18, 2011, the Orange County, California, Superior Court gave preliminary approval in a case styled Hojiwala vs. Xacta to a settlement of a nationwide class action lawsuit against retailer Idea Village Products Corporation concerning its Kinoki Detox Foot Pads. Pursuant to the settlement, all persons in the United States who bought this product are entitled to receive (1) $10 in cash for each package of the product purchased or (2) two “As Seen on TV” products that have a total retail value of $20.
The plaintiff in the lawsuit alleged that Idea Village falsely advertised that the product would detoxify the body while it was taped to the bottom the foot. The plaintiff also alleged that the manufacturer claimed that the product “draws toxins out of your body” and “remove(s) heavy metals, metabolic waste, toxins, parasites, chemicals, cellulite, and more from consumers’ bodies.”
This case shows yet again that unethical corporations will do and say anything to sell their products to innocent consumers.
