What is Sexual Hazing in California Schools?

Hazing is something we see often in shows and movies, but sexual hazing is still an unfortunately common practice in many California schools and colleges. At The Senators Firm, our sexual hazing child abuse lawyers are committed to defending the rights of hazing survivors and holding the individuals and institutions accountable.

Hazing Has Many Forms

Hazing, as a general practice, typically occurs as an initiation into a group or club. Legally, you cannot consent to hazing; it is illegal regardless of your willingness to participate. Hazing is typically centered around humiliation and degradation of potential members of the group as an attempt to establish power and control of the senior members.

Sometimes it is more subtle and difficult to identify, but it may also include drugs, alcohol, violence, and sexual components.

Signs of Hazing

It may be difficult to determine whether what you or your child experienced qualified as sexual hazing. Some of the identifying qualities of hazing include the following regarding admission into a certain club, group, or organization:

  • An activity or behavior that is inconsistent with the purpose of the organization
  • It is negligent or seemingly reckless in nature
  • The activity intentionally introduces risk factors
  • The guidelines of the activity specifically increase vulnerability
  • It unreasonably interferes with other academic activities or success

When the hazing is sexual in nature, this may include tasks that pressure you to simulate or perform sexual acts, sharing private information about sexual health or history, non-consensual touching, or other forms of sexual assault.

How is Sexual Hazing Different From Other Forms of Sexual Abuse?

Legally, hazing is a distinct crime under Penal Code 245.6, often referred to as Matt’s Law. This can mean that perpetrators are guilty of additional criminal offenses in addition to sexually related crimes. For example, a sexual assault that results from hazing may meant he perpetrator faces charges of sexual assault in addition to hazing.

Sexual Hazing Can Have Lasting Consequences

If you have experienced sexual hazing, you may have some complicated feelings about the experience. Whether it was a violation of your privacy or a sexual act to promote feelings of humiliation or vulnerability, you should know that you are not alone. Sexual hazing is unfortunately common, and recent research has shown that those subjected to it may experience long-term adverse reactions.

You Have Options

You may have criminal and civil recourse in your hazing case. While the police are typically the ones who spearhead a criminal case, you often have the ability to choose whether you participate in their investigation.

However, a civil case is completely in your control. You can choose to pursue it, and our attorneys will follow your lead on how you want to handle it at every turn.

The decision to come forward with your experience is a personal one. No one else can tell you what is best for you. However, if you want to explore your options, you can call our team from The Senator’s Firm and schedule a free case consultation to discuss your situation and determine what you can expect if you move forward with a civil case.
