Illinois Senator Asks USPLabs for Information After Reports of OxyElite Pro Liver Damage

On October 29, 2013 – nearly two weeks before Texas-based USPLabs, LLC recalled its OxyElite Pro dietary supplements from the United States market – Illinois Senator Richard "Dick" Durbin wrote a letter to the CEO and Co-Owner of the company, expressing his concern regarding reports of liver injuries among consumers who used the product. Durbin's letter cited several sources of evidence in raising the alarm about OxyElite Pro. These included:

  • An FDA "health advisory alert" on October 8, 2013 in which the FDA advised consumers to not take products labeled OxyElite Pro while they were under investigation for reported cases of liver damage.
  • A USA Today article published on October 25, 2013 that reported on findings made by Hawaii's Department of Health based on numerous cases of liver damage occurring in that state which government scientists associated with ingestion of OxyElite Pro. Several of these cases required liver transplants and one case resulted in death.
  • A warning letter from the FDA to USPLabs on October 11, 2013 stating that OxyElite Pro and VERSA-1 supplements may be "adulterated" because they contain Aegeline, a "new" dietary ingredient lacking sufficient historical or scientific evidence of safety.
  • A previous FDA consumer advisory warning involving adverse health reports for dimethylamylamine (DMAA), a stimulant found in two older USPLabs supplements, including a previous version of OxyElite Pro.

In an effort to protect consumer safety, Senator Durbin requested that USPLabs provide a written response to the following:

  • The number of serious adverse event reports received by USPLabs for all supplements manufactured since 2010.
  • Documentation for any reports requiring hospitalization, death, or liver injury.
  • A specification and description of all new dietary ingredients, including aegeline, which was used in the reformulated version of OxyElite Pro.
  • A list of USPLabs products containing aegeline and whether or not USPLabs has stopped manufacturing and distributing supplements containing aegeline.
